Can you refuse new car delivery in India? Your rights explained

Short answer: yes. If the car you're handed doesn't meet the standard you paid for, you can refuse delivery - and the law is on your side.

Buyers often feel pressured to accept a car "as is" because the payment is done and the dealer is pushing. You don't have to. As a car buyer in India you have the absolute right to conduct a PDI and to refuse delivery of a defective vehicle.

Your right to a PDI

The Consumer Protection Act, 2019

The Act gives car buyers strong protection against defective goods and deficient service. Relevant provisions include:

Your warranty starts from the date of invoice, not the date of registration - another reason not to let a car sit as old stock before delivery.

If the dealer refuses a PDI

  1. Ask for the refusal in writing, with the reason
  2. Escalate to the Dealer Principal (the dealership owner)
  3. Call the manufacturer's customer care and lodge a complaint
  4. Tag the manufacturer publicly on social media
  5. File a complaint with the District Consumer Forum
