Can you refuse new car delivery in India? Your rights explained
Short answer: yes. If the car you're handed doesn't meet the standard you paid for, you can refuse delivery - and the law is on your side.
Buyers often feel pressured to accept a car "as is" because the payment is done and the dealer is pushing. You don't have to. As a car buyer in India you have the absolute right to conduct a PDI and to refuse delivery of a defective vehicle.
Your right to a PDI

The Consumer Protection Act, 2019
The Act gives car buyers strong protection against defective goods and deficient service. Relevant provisions include:
- Section 2(6) - defines a "defect" in goods, including manufacturing defects
- Section 2(11) - defines a "deficiency" in service
- Section 35 - jurisdiction of the Consumer Commissions where you file complaints
If the dealer refuses a PDI
- Ask for the refusal in writing, with the reason
- Escalate to the Dealer Principal (the dealership owner)
- Call the manufacturer's customer care and lodge a complaint
- Tag the manufacturer publicly on social media
- File a complaint with the District Consumer Forum
Documents you must receive at delivery
- Tax Invoice - the primary proof of purchase; verify every amount, model, colour and accessory
- Form 21 - the sale certificate from the manufacturer (needed for registration)
- Form 22 - the roadworthiness certificate
- Insurance policy - check the IDV, coverage and start date
- Temporary registration - usually valid ~30 days
- Warranty card - VIN and purchase date filled in
- Service booklet and owner's manual
